Tree Planter Rental Agreement

I, the undersigned Lessee, hereby agree to rent and lease from the Montcalm Conservation District (Lessor) one mechanical tree planter, subject to the terms and conditions listed below. The agreement is in effect upon the signing and dating below. The Lessee shall pay a $100 security deposit prior to taking possession of the tree planter. The rental price is $75 per day of possession of the tree planter and is to be paid before or at the time of pickup. Lessee must contact the Lessor to cancel or reschedule. If the Lessee fails to take possession of the tree planter when scheduled, without notifying the Lessor, the deposit will be forfeited to the Lessor. If the tree planter is kept beyond the agreed return date, the Lessee shall pay $100 per day penalty fee for each day the tree planter is kept beyond the agreed return date. The Lessee agrees to allow the Lessor or its agents to enter the property of the Lessee at any time to inspect or secure the return on the tree planter. The Lessee shall pick up and drop off the tree planter at a predetermined location, where the Lessor conducts business. The tree planter is provided on a trailer with a hitch with a 1 7/8” ball and 2” x 2” ball mount. The planter requires a minimum of a 30-horsepower tractor with a three-point hitch, and the Lessee agrees to only use equipment meeting such standards. All labor, power, and lubrication necessary to operate and transport the tree planter shall be provided by the Lessee. The Lessee shall use the planter to plant in straight rows only; the Lessee shall not try to turn or contour plant and will not use the tree planter in rocky soil or stones. The Lessee shall be responsible for any damage to the tree planter due to negligence while in possession of the planter, except ordinary wear and tear as determined by the Lessor. No changes or modifications to the tree planter are allowed to be made by the Lessee. The Lessee assumes responsibility and agrees to pay for all damage to property and injury to or death of persons resulting from use, transportation, operation, maintenance, or repair of the tree planter. The Lessor makes no warranty, either express or implied, to the satisfactory results from the use of the planter. The Lessee shall indemnify and hold harmless the Montcalm Conservation District of all liability arising from the use of this planter. The deposit will be given back to the Lessee upon return of the tree planter in good condition.
